Excellent article and one that folks should be paying attention to. I work in defense litigation and I can honestly say never, ever underestimate the plaintiff's bar. Lawsuits that we ("we" meaning just plain regular folks - not folks in the legal profession) think are silly and frivolous happen every single day and it's amazing how many of them a clever plaintiff's attorney can win.
